Var kong Magnus Lagabøte kabbalist? Visse litt vage svar kan
vi finne i: Kongen, Lova og Landet: Magnus 1274, av Jørn Øyrehagen Sunde, 2023.
Denne boken er høystemt, vakker, informativ - og et funn for
alle som både i utgangspunkt og fortsetning er betatt av jussens vidunderlige –
og befriende kompliserte - verden, ja, verdens mest forunderlige og forferdelige, eller for noen: skremmende, skapte verden. Ser vi den i et islamsk perspektiv, gir den mange
ettertanker, tanker som burde være inne i bildet før heller enn etter.
Spørsmålet er altså: Var Magnus kabbalist? (Se linker med ref. til kabbala under).
Det er ikke enkelt helt å avvise en slik hypotese. Sunde
forteller om påvirkningen fra Frankrike som en del av forarbeidet til
Landsloven, og hva finner man i Paris? Jo, det jeg vil kalle sterke
indikasjoner på at kongens embetsmenn hadde latt seg påvirke av den jødiske
mystikken, (kabbala), i hvert fall ikke i ubetydelig grad. Kabbala var kommet
på moten, og ikke uten grunn. Vi kan si at kabbala har vært av en mye større
betydning for utviklingen av «Vestlig» juss « enn det de aller fleste i dag er
i stand til å forstå. Heller ikke Magnus’s samtid var klar over «hva som
foregikk» på et høyere embetsplan, kan vi si. Uten denne utviklingen, fra dette
faktagrunnlaget, ville Europa for lengst ha være full blown og hard-core
islamsk i dag. Det er min påstand.
La oss begynne med et svært enkelt utgangspunkt: I kabbala
operer man med «triader» eller «triangler» som flyter frem og ned av et øvre
sefirot, nemlig i Gud, som er Én, på toppen. Her er vi på GT’s område, og GT
var overmåte viktig for Magnus og hans hird eller hoff, i hvert fall de som
drev med lovforberedelser – mange av de beste studentene hadde nettopp studert
juss i Frankrike, hvor altså kabbala hadde fått fotfeste, se linkene under.
Det hele begynner – da det hele begynte, og gjerne før - med Keter som gjerne oversette med Kronen.
Herfra «emanerer» (i en skapelse) kraften, lyset og Personen, kan vi si,
nedover til høyre – til Hochma, visdom- og ned i øverste sefirot til venstre
(på flytdiagrammet) – i et simultant nano-sekund, (nesten okkasjonalistisk, men
mye mer gjennomtenkt). Denne sefiroten kalles Binah, dvs Intelligens eller Forståelse.
Og herfra flyter så, i stadig kryssende vertikale og horisontale kosmiske «dialektikker»
fra de andre sefirotene, f eks til Chesed eller Barmhjertighet og
Nåde/Kjærlighet, som igjen fører over til DIN og Gevurah, Makt, etc. Det må
ikke bare sees, men oppleves … (Noen spesialister operer med en egen «kristen
kabbala», se mer i linkene under.
Når Sunde så operer med «Guds fire søstre», er det lett å
assosiere til kabbala, ja, man kan nesten ikke annet, selv om Magnus bruker en
mer forenklet begrepsbruk, folk skulle jo forstå dette på mest mulig riktig pedagogisk
måte, tiden og forholdene tatt i betraktning.
Sunde og kong Magnus koker dette ned til: Sannhet, Miskunn,
Rettferd og Fred. Med litt fantasi, vil det være lett å foreta en reell kobling
til kabbalen. Vi er dermed mer jødisk-kabbalistisk inspirert her i landet den
dag i dag enn mange vil like å tro.
Men hva med islam? Det vi kan si med sikkerhet er at islam hverken
er inspirert av Magnus eller kabbala, bygget på GT (Det gamle testamenter).
En liten innledning, her fra Sunde:
Etter landslova skal ein som har forlova seg med ei
kvinne som deretter har samleie med nokon annan, ha dobbel erstatning om han
likevel giftar seg med henne: Han skal ha erstatning av hennar føresette fordi
ho har redusert giftingsverdien etter samleie, og erstatning frå den som har
hatt samleie med henne, som slik har redusert kvinnas giftingsverdi.
Regelen er enkel nok, skriver Sunde. Men kva om samleiet
var valdtekt og ikkje frivillig? … skal han framleis ha dobbel erstatning?
Lat oss konsultera Guds fire døtre: Ja, vil Sanninga
svara, dor det er slik lovordlyden er. Nei, vil Miskunn seis, for ordlyden
gjeld samlie som eit avtalebrot og ikkje når samleiet er tvinga fra. Ja, vil Rettferd
seia, for ektemannen tek ein risiko for at barn som kvinna seinare ber fram,
ikkje er hans, fordi ho har vist at ho kan ha samleie utanfor ekstskap. Nei,
vil Fred seia, for om frivillig og tvungen samleie vert handsama likt, vil den
uskuldige kvinna lida for den skuldige mannen sine gjerningar. Vi ser dermed at
Guds fire døtre ikkje er ei slags maskin der ein puttar fakta i saka på den
eine sida, og så kjem det eit enkelt svar ut på den andre. Dei er eit instrument
for å sikra at ei sak er opplyst før den vert avgjort. Men med å gjera ein
konsultasjon med Guds døtre til kriterium for at lagrettemennene kunne setja
lova til sides, oppnådde ein at saker ikkje bare vart løyst etter gammal vane,
men etter ein diskusjon der visse fundamentale vert adressert.
Sunde spør: Korleis kunne Magnus koma på denne tanken? spør Sunde. Han viser til Thomas Aquinas sin Summa om kva som var viktigast, lova sin ordlyd eller å døma etter kva som var rettvist? Han meinte at det i noen tilfelle kunne væra rom for domarane å ta omsyn til kva som var rettvist … men fordi det var få som hadde fått forstand frå Gud … var det bedre å følge ordlyden, for å unngå det virvar som vill oppstå om ein ga fridom for alle utan forstand frå Gud til å bruka retten fritt for å oppnå eit rimelig resultat … for å forstå kvifor Magnus ikkje gjorde si lovbok bindande for dei som skulle bruka den, må vi tilbake til ideen om at kongen var Guds ombudsmann på jord, slik som uttrykt i Landslova … han var forplikta til å endre retten som var i direkte strid med, eller ikkje fremma Guds vilje … s 234 f.

Livets tre er mye brukt i kabbalistisk «terapi» til selvhjelp, som det heter. Om Hanvold er kabbalist, skal jeg ikke ha sagt. Men han tillater seg frimodig å sitere et vers fra GT som sier at vi kan gjøre Gud til vår skyldner, i forbindelse med at han taler varmt for å gi tiende, (uten sammenheng for øvrig)).

Sunde forteller at Magnus ble oppdratt i fransiskanerklosteret i Bergen. Dette kan ha disponert han for fromhet her i livet og gitt gutten er forståelse av at Gud hadde gitt ham en spesiell oppgave, en oppgave han tok meget seriøst. Fransikanerne drev vesentlig med diakoni. Magnus Landslov vier da også omsorgen for de fattige særsoppmeksomhet, i forhold til tidligere lovgivning.
Sunde
forteller også at flere historikere har påstått at Magnus var en veik konge,
men Sunde mener at Magnus var genial i lovarbeidet. Kanskje var han, og hans embetsmann - hvis vi skal værelitt generøse - sterkt påvifrket av bibelsteder som følger?:

The New Testament Book of Revelation takes up Ezekiel's theme, referring to the Tree of Life in three places:
To him who conquers I will grant to eat of the tree of life, which is the paradise of God (Revelation 2.7) Through the middle of the street of the city [New Jerusalem], also, on either side of the river, the tree of life with its twelve kinds of fruit, yielding in fruit each month; and the leaves of the tree were for the healing of the nations (Revelation 22:2). Blessed are those who wash their robes, that they may have the right to the tree of life and that they may enter the city by the gates (Revelation 22:14)
There are in fact correspondences between the messianic prophecies of Isaiah 11:2 and the divine emanations of the Kabbalistic tree of life. In essence, the Isaiah foretold that the Spirit of Chokmah, Binah, Da’at and Gevurah would be found in the Messiah. The Spirit of the Lord will rest on him, the Spirit of wisdom (chokmah) and of understanding (binah), the Spirit of counsel and of might (gevurah), the Spirit of the knowledge (da’at) and fear of the Lord
In the Apocalypse
of John, there are three visionary scenes where Christ reveals, “I am the Alpha
and the Omega” (Rev 1:8, 21:6, and 22:13), the equivalent to saying, “I am the
A and the Z.” in hebrew.
